Akumaker3D Akumaker3D

Terms and conditions

These terms and conditions apply to every offer made by Akumaker3D and to every agreement concluded via the webshop. By placing an order, you agree to these terms and conditions. You can find our company details on the contact page.

Article 1. Definitions

  • Akumaker3D: the business that operates the webshop and offers the items.
  • Customer: any natural person or legal entity that enters into an agreement with Akumaker3D.
  • Consumer: a customer who is not acting in the course of a profession or business.
  • Business customer: a customer who is acting in the course of a profession or business.
  • Cooling-off period: the period within which the consumer can exercise the right of withdrawal.

Article 2. Applicability

These terms and conditions apply to every offer and every agreement between Akumaker3D and the customer. Any differing terms of the customer only apply if Akumaker3D has accepted them in writing. If a provision is void or is annulled, the remaining provisions remain in force.

Article 3. Offer and prices

All offers are without obligation. Obvious mistakes or errors in the offer, such as a clearly incorrect price, are not binding on Akumaker3D. Prices for consumers include VAT; prices for business customers are shown excluding VAT. Shipping costs are stated separately before the order is placed. Akumaker3D may change its prices; for orders already placed, the price at the time of ordering applies.

Article 4. Formation of the agreement

The agreement is formed when the customer places the order and Akumaker3D confirms receipt of it by email. Akumaker3D may refuse an order or attach additional conditions to it, for example in the event of a negative credit assessment or previous payment problems. The customer will be informed of this within a reasonable period.

Orders are processed automatically and placed with suppliers straight away. Changing or cancelling an order is therefore not always possible. If a shipment can no longer be stopped, extra return costs may apply. An order with payment in advance that has not yet been paid can be cancelled by the customer in their account; a paid order can be cancelled in consultation with Akumaker3D. The consumer's right of withdrawal (Article 7) remains fully in force.

Article 5. Payment

Payment is made using the payment methods offered at checkout. Business customers whose account has been approved by Akumaker3D can order on account within the agreed credit limit; for these orders, the payment term stated on the invoice applies. If the payment term is exceeded, the customer is in default by operation of law and owes the statutory (commercial) interest and reasonable collection costs.

Article 6. Delivery

Akumaker3D delivers to the delivery address provided by the customer. Stated delivery times are indicative; exceeding them does not entitle the customer to compensation, unless agreed otherwise. For consumers, a maximum delivery period of 30 days applies; if this is not met, the consumer may terminate the agreement free of charge. The risk of damage or loss passes to consumers at the moment of delivery and to business customers at the moment of shipment.

Article 7. Right of withdrawal (consumers)

A consumer may withdraw from a purchase within 14 days of receipt without giving any reason. The consumer notifies Akumaker3D of this within that period and returns the item within 14 days of the notification, unused, complete and, as far as possible, in its original packaging. The costs of returning the item are borne by the consumer. Akumaker3D refunds the purchase price, including the original shipping costs, within 14 days of receiving the return.

The right of withdrawal does not apply to items made or ordered to the customer's specifications, to sealed items whose seal has been broken, or to items that cannot be returned for reasons of hygiene. Business customers have no right of withdrawal; returns are only possible after consultation and in cases agreed between the parties.

Article 8. Warranty and conformity

Akumaker3D guarantees that the items comply with the agreement and meet reasonable requirements of soundness and usability. In addition to the statutory warranty, the manufacturer's warranty of the brand applies. Defects must be reported within a reasonable period after discovery. The warranty lapses in the event of improper use, incorrect installation, normal wear and tear or repair by third parties.

Article 9. Retention of title

Delivered items remain the property of Akumaker3D until the customer has paid everything they owe under the agreement.

Article 10. Liability

The liability of Akumaker3D is limited to the amount charged for the order concerned. Akumaker3D is not liable for indirect damage, such as consequential loss, loss of profit or business interruption. These limitations do not apply in the event of intent or gross negligence on the part of Akumaker3D and do not affect the statutory rights of consumers.

Article 11. Complaints

Complaints about the performance of the agreement can be submitted via the contact page. Akumaker3D will respond within 14 days. Consumers can also submit a dispute via the European ODR platform (ec.europa.eu/odr).

Article 12. Applicable law

All agreements are governed by Dutch law. Disputes are submitted to the competent court in the district where Akumaker3D is established, unless mandatory law provides otherwise.
